Terms of Service

These terms apply to orders placed by consumers in the United States, the United Kingdom, Canada, Australia and New Zealand through bergheat.com, uk.bergheat.com, ca.bergheat.com, au.bergheat.com and nz.bergheat.com. Nothing in these terms reduces any right you have under the mandatory consumer-protection law of the country where you live. Where these terms conflict with that law, the law takes precedence.

2. How a contract is formed

Product listings are an invitation to order, not a binding offer. When you click the order button, you make a binding offer to buy the items in your cart. The automatic email you receive straight after checkout confirms that we received your order; it does not yet accept it. The contract is formed when we confirm acceptance or dispatch the goods, whichever happens first.

You can review and correct your details at any point before you submit your order. We keep a record of your order and send the order details to you by email.

We may decline an order – for example if an item is out of stock, a price was displayed in obvious error, or we cannot ship to your address. If we do, we tell you and refund any payment in full.

3. Prices and import duties

Prices are shown in your local currency. Shipping costs are shown separately in your cart and at checkout – see Shipping & delivery for current rates.

Your order ships from outside your country. Import duties and handling fees charged on arrival are not included in the price. They may be charged by your customs authority or the carrier on delivery, are set by your country's rules and are your responsibility.

4. Payment

You can pay using the methods offered at checkout, listed on our Payment methods page. Payment is taken when you place the order. We use third-party payment providers; their own terms and privacy notices apply in addition to ours.

5. Delivery and risk

We deliver to the shipping address you give us. Delivery normally takes 6 to 10 business days after dispatch. This is an estimate, not a guaranteed date. The goods are at our risk until they are delivered to you or to someone you have named. If an item becomes unavailable after you order, we tell you promptly and refund any payment you have made for it.

6. Retention of title

The goods remain our property until they are paid for in full.

7. Cancellation and returns

You can cancel your order and return the goods within 14 days of receiving them, without giving a reason. The full procedure is set out on our Returns & refunds page, which forms part of these terms. In the United Kingdom this is also your statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Unless the goods are faulty or not as described, you pay the cost of returning them.

8. Product quality and consumer guarantees

Goods are supplied with the guarantees and rights required by the law of the country where you live. Nothing in these terms excludes, restricts or modifies them. In particular:

  • Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  • New Zealand: Goods come with guarantees under the Consumer Guarantees Act 1993 that cannot be excluded. If a product has a problem covered by the Act, you are entitled to the remedies it provides, such as repair, replacement or refund.
  • United Kingdom: Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. Depending on when a fault appears, you may be entitled to reject the goods for a refund, or to a repair, replacement or price reduction.
  • United States and Canada: Goods are covered by the implied warranties and consumer protections available under the law of your state, province or territory, including an implied warranty of merchantability where it applies.

If you receive a faulty or damaged item, email support@bergheat.de with photos of the product and packaging and we will put it right.

9. Using the products safely

Our heated products run on USB power at 5 V / 2 A only. Higher voltages or currents can damage the heating elements. Please follow the safety, charging and care instructions supplied with the product. Do not use a damaged garment, cable or power bank. Our heated garments are clothing, not medical devices. If you have reduced sensitivity to heat or a medical condition affecting circulation or skin sensation, speak to a doctor before using one.

10. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited in your country. Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care, and not for loss or damage that is not foreseeable, to the extent the law allows.

11. Content and trade marks

The text, images, product names and logos on this site belong to us or our licensors. You may not copy or reuse them commercially without our written consent.

12. Complaints and disputes

If something is wrong with your order, please contact us first at support@bergheat.de – most issues are resolved quickly this way. We do not take part in private arbitration or mediation schemes, but this does not affect your right to bring a claim before a court, tribunal, ombudsman or consumer regulator in your country.

13. Governing law

These terms are governed by the law of the Hong Kong Special Administrative Region. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country.

14. Changes and severability

We may update these terms. The version in force when you place your order applies to that order. If any part of these terms is found unenforceable, the rest continues to apply.
